Compliance
Is offshore tax preparation compliant?
Yes — when the taxpayer consents first and the provider's safeguards meet your WISP. Here's how that works.
IRC §7216 taxpayer consent
Under Treas. Reg. §301.7216-3, a preparer must get the taxpayer's written consent before disclosing return information to a preparer located outside the United States. The consent must follow the format in Rev. Proc. 2013-14: a separate document, signed and dated before disclosure, naming the recipient country.
How we support your consent process
We give you a Rev. Proc. 2013-14-aligned consent template, a tracking sheet and a rule that no return is opened until you mark its consent as received. You can send the consent through your client portal or engagement letter workflow.
FTC Safeguards Rule and your WISP
Tax preparers are financial institutions under the FTC Safeguards Rule (16 CFR Part 314). We document our controls so you can list us as a service provider in your Written Information Security Plan, with MFA, encryption and access logs.
IRS Publication 4557 controls
Our controls map to IRS Publication 4557: named users, MFA on every login, no local storage of taxpayer data, locked-down workstations, clean-desk rules and an incident response plan.
Your firm remains responsible for obtaining client consent. We provide a template. Get the Section 7216 Consent & WISP Kit
